The appeal allowed. The court further ordered that the learned SCJ order in allowing the sum of RM 459.783.31 set aside and instead the court order the Defendant to pay the Plaintiff the actual cost of the sale price of the timber logs which is in the sum of RM159,818.40, the transportation costs of the timber logs in the sum of RM 19,888.51 and the management costs involved for the delivery of the timber logs in the sum of RM17,359.20 which total up at RM197,066.11. All these amounts are supported by documentary evidence at pp 189, 190 and 192 of the ROA which were marked as Exh. PB1, PB2 and PB4 respectively. The post interest judgment of 5% and costs of RM15,000.00 as ordered by the Learned Session Court Judge shall remain.
